MODEL RELEASE & PUBLICATION AGREEMENT

This Model Release & Publication Agreement (“Agreement”) is entered into between Flava Girl Magazine (“Magazine”) and the undersigned model (“Model”).

1. MODEL INFORMATION

2. AGE VERIFICATION

The Model represents and warrants that she is at least eighteen (18) years of age and legally able to enter into this Agreement.

The Model agrees to provide valid government-issued identification for age and identity verification when required.

3. CONSENT TO PHOTOGRAPHY & PUBLICATION

The Model voluntarily consents to being photographed and/or recorded for content associated with Flava Girl Magazine.

Subject to the terms of this Agreement, the Model authorizes Flava Girl Magazine to use approved photographs, video, name, approved stage name, likeness, image, voice, and approved biographical information for:

  • Flava Girl Magazine print and digital editions
  • Flava Girl Magazine website
  • Official Flava Girl Magazine social media
  • Promotional materials
  • Advertising for Flava Girl Magazine
  • Model profiles and interviews
  • Promotional videos and trailers
  • Flava Girl of the Month features
  • Cover consideration and approved covers
  • Archives of previously published Flava Girl Magazine content

This Agreement does not authorize Flava Girl Magazine to license the Model's likeness to an unrelated third-party product, brand, or advertising campaign without separate authorization from the Model.

4. OWNERSHIP OF PHOTOGRAPHS

This Agreement does not automatically transfer copyright ownership of photographs submitted by the Model or created by an independent photographer.

The Model represents that she either owns the submitted material or has obtained any permission necessary to provide it to Flava Girl Magazine for the uses authorized by this Agreement.

When photographs are created specifically for Flava Girl Magazine, copyright ownership and photographer licensing terms shall be established separately where necessary.

5. IMAGE EDITING

The Model authorizes reasonable editing necessary for publication, including cropping, resizing, color correction, lighting adjustments, skin retouching, background modification, graphic design, text placement, and magazine layout.

Flava Girl Magazine may not digitally alter the Model's image to create nudity or sexually explicit content that was not actually photographed, nor materially misrepresent the Model's participation, without the Model's separate written consent.

6. CONTENT & BOUNDARIES

The Model maintains the right to decline any pose, wardrobe, concept, physical contact, or level of exposure with which she is uncomfortable.

Participation in Flava Girl Magazine does not constitute consent to nudity, simulated sexual activity, sexually explicit photography, or physical contact.

Any content requiring additional levels of exposure or materially different usage must be discussed and agreed upon before the applicable shoot or publication.

7. COMPENSATION

For the applicable feature or assignment, compensation shall be identified before publication.

Compensation Arrangement:

Unless otherwise agreed in writing, publication does not entitle the Model to royalties, residual payments, or a percentage of magazine sales.

8. NON-EXCLUSIVITY

Unless a separate written agreement states otherwise, this Agreement is non-exclusive.

The Model remains free to model, appear, publish, or work with other magazines, photographers, companies, agencies, and brands.

9. MODEL NAME & BIOGRAPHICAL INFORMATION

The Model authorizes publication under the following name:

 

Flava Girl Magazine will not intentionally publish the Model's private address, government identification number, personal telephone number, or other non-public identifying information.

10. NO GUARANTEE OF PUBLICATION

The Model understands that signing this Agreement does not guarantee:

  • Publication
  • Cover placement
  • Flava Girl of the Month selection
  • Future modeling assignments
  • Employment
  • Sponsorships
  • Endorsements
  • Additional compensation

Flava Girl Magazine retains editorial discretion regarding whether and when accepted material is published.

11. WITHDRAWAL BEFORE PUBLICATION

If the Model wishes to withdraw permission for material that has not yet been published, the Model should notify Flava Girl Magazine in writing as soon as possible.

Once an authorized edition, advertisement, social post, promotional item, or other material has been lawfully published or distributed, withdrawal will not require Flava Girl Magazine to recall, destroy, or remove copies already distributed or archived.

Any continuing future use will remain subject to the specific rights granted under this Agreement and applicable law.

12. RELEASE

To the extent permitted by law, the Model releases Flava Girl Magazine and its authorized representatives from claims arising solely from uses of the Model's image, likeness, or approved information that are expressly authorized by this Agreement.

This release does not waive claims arising from unauthorized uses outside the scope of this Agreement or rights that cannot legally be waived.

13. PROFESSIONAL CONDUCT & SAFETY

Flava Girl Magazine and the Model agree to maintain professional conduct during all authorized shoots and assignments.

The Model may stop participation in a shoot if she reasonably believes that requested activity exceeds the previously agreed concept, wardrobe, exposure level, or physical boundaries.

14. ENTIRE AGREEMENT

This Agreement represents the understanding between the parties concerning the rights specifically addressed herein. Any material expansion of those rights must be agreed to in writing.

If any provision is determined to be unenforceable, the remaining provisions shall remain effective to the extent permitted by law.

15. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles.

 

 

MODEL ACKNOWLEDGMENT

I confirm that I have read and understand this Agreement. I certify that I am at least eighteen (18) years old and am signing voluntarily.

I understand what rights I am granting to Flava Girl Magazine and have had the opportunity to ask questions before signing.
